The application must be complete at the time it is lodged and must contain all relevant information that is reasonably available to the protestant. Allegations made in the protest should be supported by documentation, data, or other satisfactory evidence.

RA 8800 impliedly provides for the disclosure of information to certain parties that may have an interest in the proceedings. The intent is to make as much information available as possible so that all parties can understand the reasons and basis of facts upon which decision are made, while still guaranteeing the protection of confidential information.

The Commission shall consider all relevant economic factors, including:

-    Significant rate of increase in imports into the Philippines indicating the likelihood of substantially increased importation, evidenced inter alia by the existence of letters of credit, supply or sales contract, the award of a tender, an irrevocable offer or other similar contracts;

Provisional measure (applied only after a preliminary affirmative determination by BIS or DA)

Under the volume test, the special safeguard duty shall be set to a level not exceeding one-third (1/3) of the applicable out-quota customs duty on the agricultural product under consideration.

The maximum initial period for the application of the safeguard measure is four (4) years.

-  Extent of redressing or preventing the injury; -  To facilitate the domestic industry’s adjustments from the adverse effects directly attributed to the increased imports;
