Brazil: CitrusBR doesn't expect to win appeal against dumping

The president for the Brazilian Association of Citrus Exporters (CitrusBR), Christian Lohbauer, said that the chances for Florida Citrus Mutual (FCM) to succeed in a possible appeal to the International Trade Court of the United States against the decision by the International Commerce Commission (ICC) to defeat the measures anti-dumping orange juice imports coming from Brazil are very low. "From the processers point of view, the producer's association in Florida mentioned that they are not giving up on the appeal," said Lohbauer.
Last month, ICC considered unanimously (6 votes), that, due to the non-existence of a dumping when selling the Brazilian drink in the US market, the accusation has no foundation. In Lohbauer's evaluation, if FCM now makes now a formal appeal to the International Commerce Court in the US, and if the request is accepted, a position will be taken in one or two years’ time, meaning, somewhere between 2013 and 2014.
"If the court accepts the appeal, a new evaluation to ICC can be requested. And that calms us, since the decision was unanimous", explained Lohbauer. "From our point of view, the chances of a victory of the present appeal are small. Even the chance of revocation is small, but if it happens, the process starts again, as no new anti-dumping tariff can be imposed", concluded the president for CitrusBR.
