Paper file folders - US investigates anti-dumping measure

On November 2, 2022, the US Department of Commerce (DOC) started an anti-dumping investigation on paper file folders imported from several countries, including Vietnam. 

 

I. Relevant information:

 

1. Initiated date: November 2, 2022

 

2. Petitioner: US Coalition of Domestic Folder Manufacturers, consisting of two companies: Smead Manufacturing Company, and TOPS Products LLC.

 

3. Goods under investigation: File folders with HS codes: 4820.30.0040 and 4820.30.0020 

 

4. Investigation period: From April 1 to September 30, 2022.

 

5. Preliminary decision:

On May 17, 2023, USDOC issued preliminary conclusions, according to which Vietnamese products were dumped in the United States with a dumping margin of 324.7%.

 

Thereafter, on June 20, 2023, the USDOC revised its preliminary determination with a revised dumping margin of:

- Three - Color Stone Stationery Company Limited (Vietnam): 93.64%
- Nationwide: 233.93%

 

6. Final decision:

 

On October 5, 2023, USDOC issued a final conclusion confirming Vietnam's dumping behavior with a dumping margin of 97.52% - 233.93%.

 

On November 13, 2023, ITC issued a final conclusion confirming that there was injury due to the dumping of Paper File Folders from Vietnam

 

Then, on November 21, 2023, USDOC decided to impose an official anti-dumping tax with the tax rate:

- Vietnam: 97.52% - 233.93%
- China: 192.7%
- India: 17.22% - 86.01%
