On November 13, 2024, the US Department of Commerce (DOC) initiated antidumping (AD) and countervailing duty (CVD) investigations into imports of hard empty capsules from Brazil, China, India, and Viet Nam. In this case, the above-mentioned products from all four countries were proposed for both AD and CVD investigations.

I. Relevant Information

1. Date of initiation of investigation:  November 13, 2024

2. Item under investigation: Certain hard empty capsulesl products (HS codes 9602.00.1040 and 9602.00.5010).

3. Investigation period: 

+ CVD: 2023

+ AD: April 2024 - September 2024

4. Preliminary Conclusion

On December 9, 2024, the United States International Trade Commission (USITC) made preliminary conclusion affirming injury due to dumping and subsidization.

On March 25, 2025, the U.S. Department of Commerce (DOC) issued the preliminary determination in the countervailing duty investigation, with a provisional countervailing duty rate of 2.15%.

On May 23, 2025, the U.S. DOC issued the preliminary determination in the anti-dumping investigation, with a provisional anti-dumping duty rate of 8.35% for Vietnamese enterprises, after making the adjustment to deduct the export subsidy rate to avoid double counting.

5. Final Conclusion:

On December 19, 2025, the U.S. Department of Commerce issued final determinations in the countervailing duty and antidumping duty investigations of hard empty capsules from Viet Nam.

According to the final determinations, the final subsidy and dumping margins for imports from Viet Nam were determined as follows:

- Final countervailing duty rate: 2.45%;

- Final dumping margin (after adjustment to export subsidies): 46.24%.

With respect to the same product, the United States also conducted concurrent CVD and AD investigations on imports from Brazil, the People’s Republic of China (China), and India.
