‘Dumping Duties on China Bike Import Ends in 2018’

BRUSSELS, Belgium – Bike Europe reported last Tuesday’s (June 3) on Ming Cycle preparing for an end on the dumping duties on bikes imported from China into the EU. This report triggered a response from the European Bicycle Manufacturers’ Association (EBMA). According to chairman Brian Montgomery the 48.5% anti-dumping duty the EU levies on bikes imported from China ends in June 2018 and not in June 2016.
Bike Europe's June 3 report highlighted the groundbreaking ceremony for Ming Cycles new factory in China'; the company's third one in which it is investing US$ 36 million (€ 26.5m). In this report Ming Cycle's sales manager Sara Tseng was quoted. She said that the investments in the new China factory are also done because the company wants to be prepared for the expected June 2016 end of the 48.5% anti-dumping duty the EU levies on bikes.General assumptionThe statement of Ming Cycle's sales manager expresses the general assumption by many in the industry that the dumping duties on bikes made in China and exported to the EU markets are to end in 2016. This is because they were announced in October 2011 and were to apply for a period of five years.However, an interim review was initiated by the European Commission in March 2012 on the October 2011 renewed anti-dumping measures. This interim review was concluded in June 2013.Valid until June 2018 EBMA Chairman Brian Montgomery responded on Bike Europe's Ming Cycle report. He said: "I would like to correct the statement of Ms Sara Tseng. The current antidumping term on PRC's originated bicycles started on 5th June 2013, and it is going to be valid for 5 years, so until June 2018."Basic Anti-dumping RegulationBrian Montgomery furthered with: "This 5 year term is stipulated in Article 11(2) of the Basic Anti-dumping Regulation."This article says: "A definitive anti-dumping measure shall expire five years from its imposition or five years from the date of the conclusion of the most recent review which has covered both dumping and injury, unless it is determined in a review that the expiry would be likely to lead to a continuation or recurrence of dumping and injury. Such an expiry review shall be initiated on the initiative of the Commission, or upon request made by or on behalf of Community producers, and the measure shall remain in force pending the outcome of such review."The EBMA chairman: "The review which ended in June 2013 covered both dumping and injury, and therefore the resulting measures expire five years from its conclusion. So that's in June 2018."
