US Department of Commerce Announces Changes in Countervailing Duty Orders on Phosphate Fertilizers from Russia and Morocco Implications and Reactions

On November 3, 2023, the U.S. Department of Commerce made a significant announcement regarding the countervailing duty orders on phosphate fertilizers from Russia and Morocco. The administrative reviews concluded with final results that had significant implications for both countries.
PhosAgro, a Russian producer, experienced a substantial increase in their countervailing duty (CVD) rate. Previously set at 9.19%, it was now raised to 28.50%. On the other hand, Moroccan producer OCP saw a decrease in their CVD rate, which dropped from 19.97% to 2.12%.
This ruling drew mixed reactions from various stakeholders, including The Mosaic Company (NYSE:MOS), a prominent phosphate fertilizer producer. Mosaic expressed disappointment with the decision regarding Moroccan imports to the U.S. In a statement, Mosaic CEO Joc O’Rourke conveyed their thoughts, stating, “We are considering our next steps. We at Mosaic expect and welcome fair competition all around the world, and we are confident that Mosaic can compete on a level playing field. We will continue to seek remedies when we see unfair practices.”
It is worth noting that Mosaic has actively pursued countervailing duties on phosphate fertilizers. Last year, the company took legal action against the United States, challenging the imposition of countervailing duties on merchandise imported from non-market economy (NME) countries. Additionally, Mosaic has faced previous challenges, including the closure of one of its facilities, which resulted in an increase in imports.
Overall, the outcome of the administrative reviews has sparked discussions among industry players and raised questions about the future of phosphate fertilizer trade. With Mosaic contemplating their next steps, the landscape of this sector could potentially undergo further changes in the coming months.
