Section 201 measures: The mechanics of Section 201

There are two stages to a Section 201 investigation and two main government actors. The first stage of the investigation is known as the injury phase. This includes an investigation by the Commission to determine whether an article is being imported into the United States in such increased quantities as to be a substantial cause of serious injury, or threat thereof, to a domestic industry producing the like or directly competitive article. If the Commission finds serious injury or threat thereof, the process enters the second stage of the investigation, known as the remedy phase. During the remedy phase, the Commission crafts recommendations for action intended to facilitate positive adjustment to import competition for the domestic industry in question. The Commission forwards its affirmative injury finding and remedy recommendation in a report to the President for final consideration and action. The President may take action in the form recommended by the Commission, impose his own remedy, or decline to take any action at all.
