On November 29, 2023, the Trade Remedies Authority of Vietnam (TRAV) received information from the Indian Directorate General of Trade Remedies (DGTR) to officially issue an investigation questionnaire in the case of sunset review of the tax imposition order. Subsidies for stainless steel welded pipes from China and Vietnam. This tax order has been issued by the Indian Ministry of Finance and is effective for 5 years from September 17, 2019.

 

1. Case information:

 

The goods under review are stainless steel welded pipes under HS codes: 7306 40 00, 7306 61 00; 7306 69 00, 7304 11 10, 7304 11 90, 7304 41 00, 7304 51 10, 7304 90 00, 7305 11 29, 7305 90 99, 7306 11 00, 7306 21 00, 7 306 29 19, 7306 30 90, 7306 50 00, 7306 90 11, 7306 90 19, 7 306 90 90. HS codes do not limit the scope of products under review.

 

According to the provisions of Section 9(6) of the Tariff Act 1975 and other relevant anti-subsidy laws of India, after 5 years of application, based on the request of representatives of the domestic industry , DGTR must conduct a sunset review to consider the necessity of continuing to apply anti-subsidy measures or consider the possibility of recurrence of subsidy practices or damage to the domestic industry if the measures are terminated. 2. Further procedures

 

- Investigation initiation date: September 30, 2023

 

- Date DGTR officially sends the survey questionnaire to manufacturers, exporters and related parties: November 28, 2023.

 

- Time limit: Relevant parties can (i) submit comments on the Plaintiff's confidentiality requests in the Request Document within 7 days from the date DGTR officially sends the investigation questionnaire; (ii) submit comments on the complaint, the scope of goods under investigation and propose a PCN (product management code) within 15 days from the date DGTR officially sends the investigation questionnaire; and (iii) submit responses to investigation questions and relevant information within 30 days from the date DGTR officially sends the investigation questionnaire.

 

- Investigation period: April 1, 2022 - March 31, 2023. Regarding damage, the investigation period will include the three most recent financial periods: 2019 - 2020, 2020 - 2021 and 2021 - 2022.

 

- Relevant parties contact and submit responses to investigation questions and/or necessary information to DGTR via email addresses: adg14-dgtr@gov.in, adv13-dgtr@gov.in; dd11-dgtr@gov.in; and dd16-dgtr@gov.in. It is necessary to ensure that verbal content is in searchable PDF/MS Word format and digital data is in MS Excel format; At the same time, comply with the instructions on answering questions according to the DGTR investigation initiation notice.

 

3. Recommendations

 

The Trade Remedies Authority recommends that manufacturers/exporters address the following issues:

 

- Carefully study documents and information related to the case;

 

- Cooperate fully and comprehensively with DGTR;

 

- Register as a related party, answer the survey questionnaire on time and in a timely manner;

 

- Regularly contact the The Trade Remedies Authority to receive timely information and support.
